The Supreme Court Judgment of April 2026 was something of a hand grenade in the area of EDI, Trans and Gender Identity issues. Despite HM Government thanking the court for ‘clarifying’ the situation, it soon became clear that things were far from clear.

A number of groups (including the EHRC) published guidelines which marginalised and excluded trans and gender non-conforming people, only to have to withdraw them under legal challenge or as they proved unworkable. Organisions such as the Women’s Institute and Girlguiding expressed deep regret at banning trans women and girls and said that they did so for fear of legal action if they did not ban them.

Understandably the immediate effect of the Supreme Court Judgment was to pause most EDI training. However most organisations realise that they cannot bury their heads in the sand. The implications of the Supreme Court Judgment will take years to uncover. Men, women and transpeople still exist and every organisation will have to work out how best they can care for and consider all of their employees, associates, customers and clients.
